# Your use of getanalog.io is governed by these terms.

These Terms of Service ("Terms") govern your use of getanalog.io, Analog's software, and the related extraction service (together, the "Service") provided by Analog Atelier Inc. ("Analog", "we", "us").

By accessing or using the Service, you agree to these Terms and our Privacy Policy. If you do not agree, do not use the Service.

Eligibility and Authority

You must be at least 18 years old and have reached the age of majority where you live to use the Service. If you use the Service for an organisation, you represent that you have authority to bind that organisation to these Terms, and "you" includes that organisation.

Accounts and Access

Access during the private alpha may require an invite. You are responsible for the activity under your account and API keys and for keeping local credentials secure. Do not share an invite or credential except as Analog expressly permits. Tell us promptly if you believe a credential has been compromised.

We may impose reasonable technical limits to protect the Service and provide fair access. The Service may change during the alpha, and features may be added, changed, suspended, or removed.

Acceptable Use and Source Responsibility

The Service processes HTML and URL content that you or your software submits. Analog does not fetch or access third-party websites on your behalf: the default fetch happens from your machine before content is submitted to the Service.

You must not use the Service to:

  • break applicable law or another person's rights;
  • access, fetch, or submit content without the rights or permissions required to do so;
  • disregard applicable website terms, robots.txt directives, or access controls;
  • probe, disrupt, overload, damage, or gain unauthorised access to the Service or another system;
  • distribute malware, spam, fraudulent material, or unlawful content;
  • harvest personal information without a lawful basis or required consent; or
  • interfere with safeguards, rate limits, or restrictions applied by the Service.

You are solely responsible for how you obtain and use submitted content and Outputs and for evaluating the legal implications of your activity. You will indemnify Analog against third-party claims, damages, and reasonable costs arising from your unlawful access to, submission of, or use of content.

Submitted Content

You retain whatever rights you hold in content you submit. Analog does not claim ownership of that content.

You authorise Analog to receive, process, and transmit submitted content only as needed to provide and secure the Service, comply with law, and enforce these Terms. This authorisation does not give Analog ownership of the content. Extraction content is not retained after the request completes; information you deliberately submit as feedback is handled as described in the Privacy Policy.

Service Outputs

"Outputs" means the structured records, markdown, metadata, and other material the Service returns in response to content you submit. As between you and Analog, Outputs belong to you. You may use, store, modify, publish, and build products and workflows upon them, subject to third-party rights in the underlying source content and the restriction below.

You may not use Outputs, individually or in aggregate, to train, fine-tune, distill, or otherwise improve a machine-learning model or other automated system for extracting structured data from web content, or a product or service that competes with the Service. Generating input/output pairs from the Service for such a purpose is a material breach of these Terms, and this restriction survives termination.

Providing Outputs to an AI model as context at inference time is not training and is not restricted by this section. You may use Outputs as context for a model to read, reason over, or act on.

Analog Intellectual Property

The Service, website, branding, and materials provided by Analog are owned by or licensed to Analog and are protected by applicable intellectual-property laws. These Terms give you a limited, non-exclusive, non-transferable right to access and use the Service while they remain in effect.

Software Analog publishes under an open-source licence is governed by that licence, not by the limited right above. Except as permitted by an applicable open-source licence or by law, you may not copy, modify, sell, sublicense, reverse engineer, or create derivative works from the Service.

Availability and Disclaimers

The Service is an alpha product and is provided on an "as is" and "as available" basis. To the extent permitted by law, Analog disclaims all express, implied, and statutory warranties, including warranties of merchantability, fitness for a particular purpose, non-infringement, accuracy, reliability, and uninterrupted availability.

Analog does not promise that an extraction will be complete, accurate, lawful for your intended use, or suitable for a particular purpose. You are responsible for reviewing Outputs before relying on them.

The Service and website may link to third-party services. Analog does not control or endorse them and is not responsible for their content or practices.

Limitation of Liability

To the extent permitted by law, Analog and its suppliers will not be liable for indirect, incidental, special, consequential, exemplary, or punitive damages, or for loss of profits, revenue, business, opportunity, goodwill, use, or data, arising from the Service or these Terms, even if advised that such loss was possible.

Some jurisdictions do not permit certain warranty exclusions or liability limitations. In those jurisdictions, these provisions apply only to the maximum extent permitted by law.

Suspension and Termination

You may stop using the Service at any time. We may suspend or terminate access if you breach these Terms, create risk or legal exposure, abuse the Service, or if we discontinue the Service. Provisions that by their nature should survive termination will survive. These include source responsibility, the competitive-training restriction, intellectual property, disclaimers, liability limits, and governing law.

Changes to These Terms

We may update these Terms as the Service changes. We will post the revised Terms here and update the date above. If a change is material, we will provide any additional notice required by law. Continued use after revised Terms take effect means you accept them.

Severability

If any provision of these Terms is unenforceable, it will be limited or removed only to the extent necessary, and the remaining provisions will remain in effect.

Governing Law

These Terms are governed by the laws of the Province of British Columbia and the federal laws of Canada applicable therein, without regard to conflict-of-law rules. Subject to any mandatory rights you have under applicable law, you and Analog submit to the exclusive jurisdiction of the courts of British Columbia.
